Soon, political and racial factors such as the Great Depression and public resentment of Mexican immigrants induce fears and paranoia about the evils of weed, resulting in 29 states outlawing cannabis by 1931.

Six years later, the Marijuana Tax Act of 1937 criminalized marijuana nationwide. The Act imposed a tax on the sale, possession, and transfer of all hemp products, criminalizing all but industrial uses of cannabis. 

A few decades after that, as part of the “War on Drugs,” President Richard Nixon signed the Controlled Substances Act of 1970. This repealed the Marijuana Tax Act and listed marijuana as a Scheduled I drug, grouping it in with drugs like heroin, LSD, and ecstasy. 

Marijuana was also identified in anti-drug programs like D.A.R.E and smeared as a “gateway drug”—90s kids will remember Daren the Lion wearing his black t-shirt and warning kids about the dangers of smoking pot.

In 1996, California became the first state to legalize marijuana for medicinal use, followed by Washington D.C., 37 other states, and US territories like Guam and Puerto Rico. As of 2022, recreational marijuana is legal in 19 states, Washington D.C., and Guam.

Are These Real Delta 9 Products?

The 2018 Farm Bill saw Congress legalize hemp and all of its derivatives. The bill defines hemp as any cannabis sativa plant containing less than 0.3% THC. While CBD is the main cannabinoid associated with hemp, the Farm Bill gave manufacturers a loophole.
